In an order from a court in a suit filed by Meta Platforms, which owns Facebook, the Delhi High Court has permanently restrained the owner of a Bangalore-based cake shop from using the name \u2018Facebake\u2019 or \u2018Facecake\u2019 or any other Facebook trademarks for its business or product and services.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"940\" height=\"326\" src=\"https:\/\/legaltax.in\/blog\/wp-content\/uploads\/2023\/02\/image-1.png\" alt=\"Judgement on Facebook\" class=\"wp-image-2136\"\/><figcaption class=\"wp-element-caption\"><strong>Source: <a href=\"https:\/\/www.facebook.com\/\" data-type=\"URL\" data-id=\"https:\/\/www.facebook.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Facebook<\/a><\/strong><\/figcaption><\/figure>\n\n\n\n<p>Cases like this are seen in the past few years and this is not unlikely to be the last. As, a dozen flea markets, Delhi chor bazaar is the one and the most famous where there is selling of shoes, watches, clothes, etc named after world-renowned brands. Popular Coffee chains, mineral water brands, fast-moving consumer goods (<a href=\"https:\/\/corporatefinanceinstitute.com\/resources\/valuation\/fast-moving-consumer-goods-fmcg\/\" target=\"_blank\" data-type=\"URL\" data-id=\"https:\/\/corporatefinanceinstitute.com\/resources\/valuation\/fast-moving-consumer-goods-fmcg\/\" rel=\"noreferrer noopener\"><strong>FMCG<\/strong><\/a>) companies, and many others have had to grapple with violations of Intellectual Property Rights (<strong><a href=\"https:\/\/www.ipindia.gov.in\/\" target=\"_blank\" data-type=\"URL\" data-id=\"https:\/\/www.ipindia.gov.in\/\" rel=\"noreferrer noopener\">IPR<\/a><\/strong>).<\/p>\n\n\n\n<div class=\"wp-block-group has-luminous-vivid-amber-to-luminous-vivid-orange-gradient-background has-background has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\">\n<div id=\"affiliate-style-d81c43ca-89a7-43d8-990c-80fea8023e89\" class=\"wp-block-affiliate-booster-ab-icon-list affiliate-block-d81c43 affiliate-iconlist-wrapper\"><div class=\"affiliate-iconlist-inner aff-list-isshow-icon\"><div class=\"affiliate-block-advanced-list affiliate-icon-list affiliate-alignment-left\"><ul class=\"affiliate-list affiliate-list-type-unordered affiliate-list-bullet-arrow-alt-circle-right\"><li><strong>Objection Notice<\/strong><\/li><li><strong>We will assess the requirement for objection<\/strong><\/li><li><strong>Affidavit Preparation and industry-specific reply<\/strong><\/li><li><strong>End-to-End Discussion<\/strong><\/li><\/ul><\/div><\/div><\/div>\n\n\n\n<div class=\"wp-block-buttons is-layout-flex wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link has-luminous-vivid-orange-to-vivid-red-gradient-background has-background wp-element-button\" href=\"https:\/\/legaltax.in\/trademark-infringement.php\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Trademark Infringement<\/strong><\/a><\/div>\n<\/div>\n<\/div>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-contrast-3-color has-alpha-channel-opacity has-contrast-3-background-color has-background\"\/>\n\n\n\n<p><strong><a href=\"https:\/\/legaltax.in\/trademark-registration.php\" target=\"_blank\" rel=\"noreferrer noopener\">Trademark<\/a> <\/strong>under Indian law is a mark that is capable of being represented graphically and which is capable of distinguishing the goods or services of one person from those of others and may include the shape of goods, their packaging, and a combination of colors<strong>.<\/strong><\/p>\n\n\n\n<p>So, anyone trying to deceptively use a brand that is similar to another popular brand (e.g. in font, format, color scheme, etc.) is an infringer or is called a violation of the trademark act and also be called trademark infringement. Other things such as the brand\u2019s international presence, application, and reputation built during the time also determine if one is entitled to protect those marks. In cases like these, the conduct of the alleged violator has to be taken into account. The look and feel of the cake shop were quite similar, so it comes in the ambit of unfair advertising. The shop was riding on Facebook\u2019s reputation, diluting its marks.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"why-are-we-calling-this-a-case-of-a-href-https-legaltax-in-trademark-infringement-php-trademark-infringement-a\"><span class=\"ez-toc-section\" id=\"Why_are_we_calling_this_a_case_of_Trademark_Infringement\"><\/span><strong>Why are we calling this a case of Trademark Infringement?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The mala fide intent of the defendants is evident from the fact that upon the knowledge of the ad-interim injunction passed by this Court, the defendants changed the mark from \u2018Facebake\u2019 to \u2018Facecake\u2019 thereby changing only one alphabet, however, chose not to appear before this Court to defend the suit in spite of service,\u201d reads the order. Meta Platforms 2020 had filed a suit against Noufel Malol, the owner of \u2018Facebake\u2019, for a permanent injunction to restrain him from using the mark \u2018Facebake\u2019, the website<\/p>\n\n\n\n<p><strong><a href=\"http:\/\/www.facebake.in\/\" target=\"_blank\" rel=\"noreferrer noopener\">\u2018www.facebake.in\u2019<\/a><\/strong> and related email ids. The court, in November 2020, passed an interim order in favor of Meta and confirmed the order in January 2021, since no one appeared on behalf of the defendants. Meta through an application letter apprised the court that Malol has incorporated a company by the name of \u2018Ehrlich Foods and Beverages Pvt Ltd\u2019 which has preferred a trademark application for registration of a deceptively-similar mark \u2018Facecake\u2019. Since no one appeared for Malol or the company, the court proceeded ex-parte in the case.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"the-statement-was-given-by-justice-navin-chawla\"><span class=\"ez-toc-section\" id=\"The_statement_was_given_by_Justice_Navin_Chawla\"><\/span><strong>The statement was given by Justice Navin Chawla<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p><strong><a href=\"https:\/\/dhcmediation.nic.in\/profile\/honble-mrjustice-navin-chawla-45\" target=\"_blank\" data-type=\"URL\" data-id=\"https:\/\/dhcmediation.nic.in\/profile\/honble-mrjustice-navin-chawla-45\" rel=\"noreferrer noopener\">Justice Navin Chawla<\/a><\/strong> said the shop owner will deliver all finished and unfinished materials, including locks, signage, cards, stationary, accessories, packaging, labels, and other material bearing the \u2018Facebake\u2019 marks or any mark deceptively similar to <strong><a href=\"https:\/\/www.facebook.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">Facebook<\/a><\/strong>, to Meta for the purpose of erasure or destruction.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"330\" height=\"250\" src=\"https:\/\/legaltax.in\/blog\/wp-content\/uploads\/2023\/02\/image-2.png\" alt=\"Justice Navin Chawla given - Judgement on Facebook\" class=\"wp-image-2139\"\/><figcaption class=\"wp-element-caption\"><strong>Source: <a href=\"https:\/\/dhcmediation.nic.in\/profile\/honble-mrjustice-navin-chawla-45\" data-type=\"URL\" data-id=\"https:\/\/dhcmediation.nic.in\/profile\/honble-mrjustice-navin-chawla-45\" target=\"_blank\" rel=\"noreferrer noopener\">HON&#8217;BLE MR.JUSTICE NAVIN CHAWLA<\/a><\/strong><\/figcaption><\/figure>\n\n\n\n<p>The court also awarded nominal damages of <strong>Rs 50,000<\/strong> in favor of <strong><a href=\"https:\/\/about.meta.com\/\" target=\"_blank\" data-type=\"URL\" data-id=\"https:\/\/about.meta.com\/\" rel=\"noreferrer noopener\">Meta<\/a><\/strong> and asked the shop owner to pay the cost of the suit to the social media giant. It said that though there is some distinction between the marks of Meta and the defendant, the overall visual representation adopted by the defendant clearly depicts \u201cthe mala fide intent\u201d
