Customers learn to trust it long before they remember your phone number. And because it is just an image file, it is also one of the easiest things in your business to copy.

This guide walks through how to trademark a logo in India, in the order things actually happen: what you check before filing, which class to pick, what it costs, what the Registry may object to, and how long you should realistically wait. It is based on the Trade Marks Act, 1999 and the Trade Marks Rules, 2017. Every case is a little different, so treat this as a map, not legal advice for your exact situation.

The short answer

To trademark a logo in India you need to:

Confirm you own the artwork.

Search the Trade Marks Registry for similar marks.

Choose the right class (or classes) for your goods or services.

File Form TM-A online with the logo, your details and a clear description.

Reply to any examination report.

Get through publication in the Trade Marks Journal and the opposition window.

Receive your registration certificate.

Nobody can guarantee that last step. The Registry decides, and a well-prepared file simply gives you better odds and fewer surprises.

What does a logo trademark actually protect?

A logo trademark protects your logo as you filed it, for the goods or services you listed, in the classes you chose. It does not give you a monopoly over a similar-looking design in every industry.

Logos generally come in three forms:

Device mark: only a symbol or image, no words.

Stylised word mark: your name written in a distinctive font or layout.

Composite mark: words and a symbol together in one design.

If you are thinking about the name as well, our guide to trademark registration in India explains how name and logo filings work together.

Why register a logo when registration is optional?

Indian law does not force you to register. But the difference shows up the day someone copies you.

A registered owner can sue for infringement. An unregistered owner usually has to rely on passing off, where you must prove your reputation first. That is slower and harder.

Your logo appears in the Registry’s public record, so a competitor searching before they launch will see it is taken.

Marketplaces and platforms often ask for a registration number before they act on a copied-brand complaint.

A registered mark can be sold, licensed or assigned (see trademark assignment), which makes it a real business asset.

It can be the base for international trademark filings. Indian applicants can claim priority in other countries if they file there within six months of the Indian filing date.

If you are already facing a copycat, read our note on trademark infringement before you do anything else.

Can you trademark a logo?

In most cases, yes. Anyone who claims to be the proprietor of a mark that is already in use, or that they plan to use, can apply. You do not need to have made a single sale. Individuals, proprietors, partnership firms, companies and LLPs can all file.

What decides the outcome is whether your logo clears examination:

Section 9 (absolute grounds): the Registry can refuse a logo that has no distinctive character, only describes the goods, or is common in the trade. A picture of a mango for a mango seller is a classic example.

Section 11 (relative grounds): the Registry can refuse a logo that is identical or deceptively similar to an earlier mark for similar goods or services.

Logos that copy national flags, government emblems or similar symbols run into separate restrictions.

The more original and distinctive your design, the easier this gets.

Who owns the logo? Check this first.

This is the mistake that surprises people most. If a freelancer or design agency made your logo, the copyright can stay with the designer unless a written assignment says otherwise. Before you file, get a signed assignment, or at least a clear clause in the design contract that transfers the rights to you.

A logo is protected as an artistic work under copyright law, and you can read more in our copyright registration guide. Design registration, by the way, is a different thing. It covers the look of a product, such as a bottle shape, not a brand logo.

How to trademark a logo in India: step by step

Step 1: Finalise the design

Freeze the logo before you file. If you change it substantially afterwards, you will usually need a fresh application. Colour matters too: a black-and-white filing generally is not tied to specific colours, while a colour filing may be limited to the colours you show. Decide this with your advisor.

Step 2: Search for conflicts

Search the Registry for the same or similar names and for similar-looking designs. Do not stop at your own class; check related ones too. Searching is not legally compulsory, but skipping it is the fastest way to an objection or an opposition. We explain the method on our trademark search page.

Step 3: Decide what to file

You can file the name as a word mark, the design as a device mark, or both together as a composite mark. The comparison table below shows how they differ.

Step 4: Pick your classes and write the description

Choose the classes that match what you sell under the logo and describe your goods or services precisely. More on this below.

Step 5: Confirm your applicant category

IP India charges a lower official fee to individuals, startups and small enterprises. Everyone else pays the higher rate. If you qualify as a startup or small business, keep your recognition or MSME certificate ready. See our pages on startup registration and MSME registration if you do not have one yet.

Step 6: File Form TM-A online

Log in to the IP India e-filing portal, select Form TM-A, enter your details, upload the logo, add your goods or services, attach any needed documents, pay the fee and submit. Save the acknowledgement and your application number. You will need it for everything that follows. You can file one class or several in a single application.

If you would rather not do this yourself, our team can handle the trademark registration end to end.

Step 7: Examination

A Registry examiner reviews the application. You either get acceptance for publication or an examination report listing objections.

Step 8: Reply to objections, if any

You file a written reply and, if called, attend a hearing. Details in the objection section below.

Step 9: Publication and opposition

An accepted logo is published in the Trade Marks Journal. Anyone who thinks your logo harms their rights can oppose it. The window is three months from publication, which can be extended by one month on request, so plan for about four. If nobody opposes, or any opposition fails, the mark proceeds to registration. See trademark opposed for what that process looks like.

Step 10: Registration

The Registry registers the mark and issues the certificate. Your registration is dated from the day you filed.

You can follow each stage online using the application number. Check it regularly. Once an examination report or hearing notice is issued, deadlines start running.

Word mark, logo mark or composite mark?

Word mark

Logo (device) mark

Composite mark

What it protects

The words or letters, in any font

The specific visual design

Words and design together, as shown

Strength

Broad protection for the name itself

Protects how the logo looks

Protects the combined presentation

Weak spot

Does not protect the design

A redesign may fall outside it

Protection for the words alone can be narrower than a separate word-mark filing

If customers know you by your name, a word mark is usually the first filing worth making. If your symbol does the talking, protect the device. Many businesses end up filing both, and each filing carries its own official fee.

Documents you will need to trademark a logo

What you need depends on who you are and how you file. Keep these ready:

Applicant details: name, address, email, phone and legal status. Professional fees for search, filing, replies and monitoring are separate and depend on scope. Costs also grow if you file in more classes, receive an objection, need a hearing, or face an opposition. Our packages and pricing page shows what we charge.

Choosing the right class

A logo does not have a class of its own. You pick classes based on what you sell under it. India uses the Nice Classification: classes 1 to 34 are goods, classes 35 to 45 are services.

Clothing label: Class 25

Software product: Class 9, and often Class 42

Restaurant or cafe: Class 43

Marketing or consulting agency: Class 35

A few practical rules:

List what you sell today and what you will realistically sell within the next year or two.

Be specific. Vague, very broad descriptions attract objections.

Do not assume you can widen the description later. Goods and services generally cannot be broadened after filing, and you may need a new application.

Every extra class means another official fee, so balance protection against budget.

IP India provides a goods and services classification search tool that helps you find acceptable wording.

How to check whether a logo is already taken

Use the free search tools on IP India’s Search Existing Trademarks page. There is an AI-based search and the standard public search. When you search:

Try spelling variations and phonetic equivalents, not just your exact name.

Look for designs that share a key visual element, not only identical ones.

Check your class and the related ones.

Include pending applications, not just registered marks.

A clean search lowers your risk but cannot remove it, because examiners and opponents may see similarity differently than you do. For a professional check, see our trademark search service.

What if you get an objection?

An objection is not a rejection. It means the examiner has raised concerns, and you get to answer.

Typical reasons for logo objections:

The logo looks descriptive or lacks distinctiveness (Section 9).

It resembles an earlier mark (Section 11).

The goods or services description is unclear.

There are questions about the claimed use date or the applicant’s details.

What to do:

Read the examination report closely and note the grounds and the deadline. The reply period is generally 30 days from the report, so confirm the date printed on yours.

File a written reply with your arguments and evidence. Narrowing the description of goods can sometimes help.

Attend the hearing if one is fixed.

Wait for the decision. The Registry can accept the mark, accept it with conditions or a disclaimer, or refuse it. A refusal can be challenged before the High Court.

We cover this stage in detail on our trademark objection reply and trademark hearing pages.

How long does it take to trademark a logo?

There is no fixed timeline, and anyone quoting you an exact registration date is guessing.

A clean application goes through examination, publication and the opposition window before registration.

An objection adds time for the reply and a possible hearing.

An opposition adds formal proceedings that can run for a long time.

Plan on many months, and sometimes more than a year. You can pay for expedited examination, but that only speeds up the examination step. It does not skip the opposition window and it does not promise a result.

Validity and renewal

A registered trademark lasts 10 years from the date of filing. After that you can renew it for further 10-year periods, again and again, as long as you pay on time. Online renewal costs ₹9,000 per class. Miss the date and you move into the surcharge route and then restoration, both costlier. Diarise the renewal date, or let our trademark renewal service track it.

Registration is not a reason to stop using the mark. If a registered mark goes unused for a long stretch, someone can apply to remove it for non-use. Very well-known brands can also seek well-known trademark status for wider protection.

Frequently asked questions

1. How do I trademark a logo in India?

Search the Registry, pick the right class, and file Form TM-A online with your logo, details and goods or services. Then respond to any objection and wait through publication and the opposition window. Results and timing cannot be guaranteed.

2. How much does it cost to trademark a logo?

Online filing costs ₹4,500 per class for individuals, startups and small enterprises, and ₹9,000 per class for everyone else. Professional fees, extra classes, objections, hearings and oppositions add to that. Confirm current rates on IP India’s fee page.

3. Can I file a logo trademark online?

Yes. Applications go through IP India’s e-filing portal, and the online fee is lower than the physical one. You can file yourself or through an attorney or agent.

4. Which documents do I need?

Applicant details, the logo file and a description of your goods or services. Depending on your case, also a user affidavit for prior use, a Power of Attorney and proof of startup or small-enterprise status.

5. Which class should I choose?

The one that matches what you sell under the logo. Goods fall in classes 1 to 34 and services in 35 to 45. If you offer both, you may need more than one class.

6. Should I register my name or my logo first?

Whichever your customers recognise you by. A word mark protects the name in any font, while a logo mark protects the design. Many businesses eventually file both, each with its own fee.

7. Can I trademark a logo someone else designed?

Only if you have the right to use and register it. Get a written copyright assignment from the designer and make sure the design is original.

8. Do I need a registered company to apply?

No. Individuals and sole proprietors can apply. Company registration is not a prerequisite for a trademark, and it does not replace one.

9. Can I use my logo while the application is pending?

Yes, with the ™ symbol. Do not use ® until the mark is registered. If the logo actually belongs to someone else, though, pending status will not protect you from a claim.

10. Can someone use a similar logo after I file?

Filing does not stop them, and you generally cannot sue for infringement until the mark is registered. If your logo has built up goodwill, passing off may still be available. Once registered, your rights run from your filing date. If you spot a similar mark in the Journal, you can oppose it within the opposition window. For active disputes, see trademark infringement.

Need help with your logo trademark?

A logo application is a series of small decisions: what to file, which classes, how to describe the goods, how to answer an objection. Getting them right at the start saves time and money later.

LegalTax can help with Registry searches, class selection and description drafting, filing Form TM-A, objection replies and hearings, opposition proceedings and renewals. We cannot promise registration or a date, because the Registry decides, but we can help you file a clean application and respond properly at every stage.

Start with our trademark registration service or browse all trademark services in India.

Phone: +91 9711939395 | Email: info@legaltax.in | WhatsApp | Contact form

Views: 30 Your logo is on your invoices, your packaging, your Instagram page and your website.
